FT. LAUDERDALE, Fla., Dec. 22 – A stockbroker who was held accountable by a FINRA Arbitration Panel for his sister’s investment losses is facing another claim for damages.
This time from a GlaxoSmithKline retiree and his wife. The law firm of securities fraud attorney Mark A. Tepper has filed claim with FINRA against Tampa-based brokerage firm Calton & Associates, Inc. for the activities of its stockbroker Kenneth Popek on behalf of the retired Florida couple. “Respondent put Claimants in harm’s way by making unsuitable recommendations and failing to supervise its broker’s activities in Claimants’ accounts. Calton’s broker misled Claimants into giving him their hard-earned retirement savings by telling them he was going to make money for them while misrepresenting the safety of Respondent’s high risk investment strategy,” the claim alleges.
This is the fourth family of clients that attorney Mark A. Tepper is representing in arbitration claims filed against Calton & Associates. “On January 26, 2010, the same broker was found liable for unsuitable recommendations substantially similar to this arbitration,” the claim notes, referring to the full recovery of all losses plus interest, attorney fees, forum fees, costs and punitive damages that were awarded by a FINRA arbitration panel following representation by attorney Mark A. Tepper against the Respondents. “Respondent’s broker recommended high risk stocks, inverse and leveraged Exchange Traded Funds (“ETFs”), and naked put options for Claimants’ accounts,” the claim alleges. “Investors who believe they’ve been the victims of stockbroker fraud should investigate their legal rights to determine the merits of potential claims,” Mr. Tepper said.
