Ft. Lauderdale, Fl. July 23 – A retired police captain who is the brother of a stockbroker has filed claim against him, alleging that his activities and those of Tampa based securities dealer Calton & Associates, Inc., resulted in enormous losses to his savings. The claim also alleges that the broker told his brother that he would make him a millionaire. The claim, filed with the Financial Industry Regulatory Authority (FINRA), by the law firm of securities fraud attorney Mark A. Tepper, alleges that the broker recommended unsuitable strategies which over-concentrated the former police captain’s accounts in high risk stocks, complex and leveraged Exchange Traded Funds (“ETFs”) as well as an options strategy. “Calton’s failure, to supervise its broker’s unsuitable activities in the retired police captain’s accounts, was inexcusable,” the claim contends. “There were sufficient indications of wrong doing (“red flags”) to alert a vigilant supervisor to speak with the customer. Had they done so, they would have quickly realized that he did not understand what the broker was doing in his accounts and the broker was initiating and controlling the unsuitable trading,” the claim alleges. The claim contends that Calton & Associates is liable for punitive damages. Mr. Tepper also recently filed claim against Calton and Associates on behalf of a former New Jersey police officer disabled in the line of duty. Mr. Tepper previously represented a Fort Myers couple with their claim against Calton. The 2010 award for damages, obtained for the couple, stated, in part, “Respondent Calton’s failure to detect [the broker’s] wrongful conduct and failure to supervise the investments in Claimants’ accounts rose to the level of gross negligence pursuant to Florida Statute 768.72.” About Mark A.
