– Customer Claim filed by Mark Tepper law firm alleges
Ft. Lauderdale, Fl. January 14, 2019 – A Florida couple saving for retirement, has filed claim for damages against Tampa-based brokerage firm Calton & Associates, alleging that its broker, Jimmy Makris, created a fictional investment profile for them to fit his high risk, high commission strategy, in pursuit of his own financial interests.
The Claim, filed by the law firm of Mark A. Tepper, P.A., alleges that the Calton & Associates stockbroker mismarked the couple’s investment profile for high risk and income, exposing them to his unsuitable high risk, high commission recommendations. The Claim contends that these included below investment grade bonds (“junk bonds”), illiquid, non-traded REITs and variable annuities.
“This case is about Respondent and its broker violating numerous FINRA rules of conduct, as well as the Florida Securities and Investor Protection Act (“FIPA”), by putting their financial interests ahead of Claimants’ best interests,” the Claim alleges.
The Mark Tepper law firm has successfully represented several clients with their claims against Calton & Associates. An award for damages, obtained for a Fort Myers couple, stated, in part, “Respondent Calton’s failure to detect [the broker’s] wrongful conduct and failure to supervise the investments in Claimants’ accounts rose to the level of gross negligence pursuant to Florida Statute 768.72.” Mr. Tepper has also filed claims against Calton and Associates on behalf of a former police officer disabled in the line of duty, a retired police captain, an FSU Alumnus, and a retired GlaxoSmithKline employee.
